Terms of service

1. Agreement

These terms are a contract between you and AI Character ("we", "us") covering your use of AI Character at www.aicharacter.com (the "Service"). By creating an account or using the Service you accept them. If you use the Service for an organisation, you confirm you can bind it.

2. Accounts

You need a Google account to sign in. You are responsible for activity on your account and for keeping access to it secure. You must be at least 13 years old (or the minimum age in your country) and, if you are under 18, have a parent or guardian's permission.

3. Credits, plans and packs

Renders are paid for with credits. The cost of each action is shown before you confirm it and is deducted when the request is accepted. New accounts receive a one-time grant of free credits.

Subscriptions (Sketch, Studio) add a monthly allowance of credits that resets at the start of each billing period. Unused subscription credits do not roll over. Packs (Ink Pack, Vault Pack) are one-time purchases whose credits never expire. Subscription credits are spent before pack credits.

You can cancel a subscription at any time from the billing portal; it stays active until the end of the paid period. Prices may change; we will give notice before a change affects an active subscription.

4. Refunds

Credits come back only if a request is stopped before it reaches the AI model. Once it has been sent, failed renders and safety rejections are not refunded.

Because generation costs are incurred the moment a request is sent to the model, we cannot refund credits for results you dislike, for failed renders, or for prompts rejected by safety checks after submission. Purchases of plans and packs are not refundable except where the law requires.

5. Your content and our licence to it

You keep whatever rights you hold in the descriptions, prompts and reference images you provide ("Input"). You confirm you have the right to use them and that they do not infringe anyone else's rights.

Subject to these terms, we assign to you all right, title and interest we may have in any output produced by the service at your direction, including without limitation images, videos, text, and other content ("Output"). You may use Output for any lawful purpose, including commercially. Because similar Input can produce similar Output for other users, we cannot guarantee that Output is unique, and copyright protection for AI-generated material varies by country; consult a lawyer about your situation.

You grant us a worldwide, non-exclusive, royalty-free, sublicensable licence to host, store, reproduce, modify, process, transmit, display and otherwise use your Input and Output for the purposes of operating, securing, supporting, promoting and improving the Service, including by using it to train, evaluate and improve models and systems and by displaying it in connection with the Service, unless you delete it or applicable law requires otherwise. This licence survives termination to the extent necessary to keep operating the Service.

6. Acceptable use

You must not use the Service to create, upload or request:

• Sexual or sexually suggestive content of any kind.
• Any depiction of minors, or characters presented as minors, in any context.
• A real person's likeness without that person's consent, including public figures, or content that impersonates a real person or organisation.
• Content that is hateful, harassing, violent, deceptive, or that promotes self-harm or illegal activity.
• Content that infringes someone else's intellectual property or privacy rights.

We use automated and manual checks. Prompts or uploads that violate these rules are rejected, and repeated violations may result in suspension or termination without refund.

7. Deletion

You can delete any image or clip from the studio. Deleting a character deletes its creations: every image, clip, upscale and reference that belongs to it. Deletion is permanent. You can delete your account by emailing us from the address you signed in with.

8. Availability and changes

The Service relies on third-party AI platforms and may be slow or unavailable at times. We may change, suspend or discontinue features, styles or models. We will try to give notice of material changes, but we are not liable for downtime or for changes in the look of renders over time.

9. Disclaimers and liability

The Service is provided "as is" without warranties of any kind. AI output may be inaccurate, inconsistent or unsuitable for your purpose; review it before you rely on it. To the fullest extent permitted by law, our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim, and we are not liable for indirect, incidental or consequential damages.

10. Termination

You can stop using the Service at any time. We may suspend or terminate accounts that breach these terms. On termination your right to use the Service ends; sections about ownership, licences, disclaimers and liability survive.

11. Governing law

These terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Delaware, unless your local law gives you the right to bring claims elsewhere.
